Strategic Collaboration

Obtaining a positive outcome in commercial litigation begins with defining what the win looks like. We begin by digging deep to understand the situation, the client, the client’s business, and how this all fits into the facts of the dispute. We work with the client to map out a strategy for resolving the dispute—defining expectations for what we intend to accomplish, and then executing the plan to get the results our client wants.

Every case and client has unique complexities, and we prepare the strategy accordingly. Sometimes we may recommend the client file a lawsuit and become a plaintiff. Other times a client is being sued and we will work with them to understand the claims and causes of action so we can use the facts to create a stout defense. Sometimes we want to get to the courthouse immediately and fight hard, or perhaps we want to avoid court completely. In these instances we often suggest an alternative route to settling cases, such as negotiation, mediation or arbitration. We aim to take the approach that best serves our client's needs.

No matter what course of action we recommend to a client, we know that cost containment is important. Fully litigating a case can take considerable time and money. If it is possible for us to help our clients take a more efficient and economical route to a solution, we endeavor to do so.
