The Foreign Corrupt Practices Act (FCPA): What Every Company Needs To Know
The Foreign Corrupt Practices Act is here to stay, and compliance with its provisions is an ever-expanding concern as companies operate in the increasingly global marketplace. In 2010, the Department of Justice (DOJ) and the Securities and Exchange Commission (SEC) continued to emphasize the FCPA as a top enforcement priority. This enhanced enforcement activity has resulted in a huge increase in fines and penalties, and eight of the top ten FCPA settlements are from 2010.
Now more than ever, it is essential that all companies with international operations or agents be fully familiar with the requirements of the FCPA and the regulators’ view of “best practices.” Join us for a comprehensive overview of the FCPA and an update on enforcement trends from partners in our Corporate Compliance, Investigations and Defense practice group, Spencer Barasch, Paul Mitchell, and Dena Palermo.
Key takeaways from this program include:
- An overview of FCPA requirements
- Covered persons and penalties
- Joint SEC/DOJ enforcement trends
- Red flags and other warning signs
- Exceptions and defenses
- Proactive and remedial measures, including lessons learned from successful investigations
