Jennifer is an associate in the energy and litigation practice groups in the Washington, D.C. office. Her practice includes the representation of energy industry participants before federal and state agencies charged with jurisdiction over energy markets and their participants.
Since joining Andrews Kurth, Jennifer has worked on a variety of energy related proceedings, including the representation of both natural gas companies and electric generators before the Federal Energy Regulatory Commission (“FERC”). Jennifer has been involved in advising clients regarding the appropriate treatment, for Natural Gas Act ratemaking purposes, of various costs incurred by pipelines and related issues involving jurisdictional rates. She also advises natural gas companies on tariff-related issues.
Jennifer’s practice also focuses on regulation of the electric industry under the Federal Power Act, the Public Utility Holding Company Act of 2005 and the Public Utility Regulatory Policies Act of 1978, and she has experience with respect to wind and hydro facilities as well as traditional gas and coal-fired facilities.
Representative Experience
Jennifer has been deeply involved in multiple NGA Section 4 proceedings. She advised Northern Border Pipeline Company on the filing of its most recent NGA Section 4 general rate case and also represents Portland Natural Gas Transmission System. Jennifer also recently represented shipper interests in a pipeline’s contested NGA Section 4 general rate case. Jennifer’s natural gas experience also includes:
- Advising clients with respect to numerous natural gas-related issues, including rate design, cost allocation, income tax allowances and billing determinant levels, as well as issues related to the FERC’s Discounted Cash Flow analysis.
- Advising clients regarding the scope of permissible activities under blanket certificates and open season procedures and requirements.
Jennifer also has experience with respect to a wide variety of electric-related issues and industry participants, including power marketers, exempt wholesale generators and qualifying facilities. Jennifer’s electric experience includes:
- Advising clients regarding the sale and acquisition of FPA-jurisdictional facilities and obtaining FERC authorizations for a variety of transactions, including mergers between significant energy industry participants.
- Advising clients with respect to the FERC’s market-based rate policies and being among the first to file market-based rate applications under the FERC’s new market-based rate standards set forth in Order No. 697.
- Counseling electric generators on various interconnection-related issues, including queue position and the applicability of various aspects of interconnection procedures and agreements.
- Representing a hydro-facility owner in a licensing proceeding before the FERC.
