A partner with the firm, Dillon deals with oil and gas law, with a focus on both transaction and litigation matters. He has experience representing companies and individuals engaged in oil and gas activities, including exploration, production, processing, transportation, marketing and consumption. Specifically, Dillon has represented buyers and sellers in the purchase and sale of oil and gas assets, lessees and lessors in all phases of oil and gas leasing, lenders and borrowers in financing and workouts related to oil and gas activities, and parties engaged in domestic and foreign disputes, including administrative proceedings, litigation and arbitration.
Representative Experience
For the last 10 years, Dillon’s practice has primarily been focused on oil and gas litigation and arbitration. He has handled complex, multi-faceted oil and gas litigation and arbitration matters in various jurisdictions, including:
- Case No. 70 198 00042 01; Cheniere Energy, Inc. and Cheniere Energy Operating Co., Inc. v. DTVN Holdings, Inc. and Zydeco Exploration, Inc., before the American Arbitration Association. Represented Cheniere Energy, Inc. in a dispute involving ownership of seismic and interpretation of an exploration participation agreement. The case was tried to a panel of three arbitrators under AAA arbitration rules and resulted in an award in favor of Cheniere.
- Case No. BC244203; The Newhall Land and Farming Company v. Kerr-McGee Corporation, Kerr-McGee Oil & Gas Onshore LLC, Kerr-McGee Oil & Gas Onshore LP, Medallion California Properties Company, and DOES 1-60, in the Superior Court, State of California, County of Los Angeles Central District. Represented KCS Energy, Inc. in a dispute in California state court (Los Angeles County) involving alleged environmental damage resulting from historical oil and gas operations on the largest undeveloped tract of land in Los Angeles County. After being scheduled for trial, the case settled on terms favorable to KCS.
- Case No. H-02-4261; FG Hemisphere Associates, L.L.C. v. République du Congo, et al., in the U.S. District Court, Southern District of Texas, Houston Division. Represented FG Hemisphere Associates, L.L.C. in a dispute in U.S. District Court for the Southern District of Texas involving garnishment of oil and gas payments owed to the Republic of Congo by United States oil and gas companies. After extensive discovery and two interlocutory appeals to the U.S. Court of Appeals for the Fifth Circuit, the case settled on terms favorable to FG Hemisphere.
- JAMS Reference #1310017310; Torch Royalty Company, et al. vs. Wilmington Trust Company, et al. Represented Constellation Energy Partners in a dispute arising out of interpretation of oil and gas conveyancing documents involving millions of dollars in potential exposure. The case was tried to a panel of three arbitrators under JAMS arbitration rules and resulted in an award in favor of Constellation.
- Cause No. C200900388; Curtis T. Laird and Lanell A. Laird, et al. v. Rimrock Energy, LLC, Prime Resources, L.P., CH4 Energy II, LLC, Henry Roe, Ed Flanagan, Terry Dobkins, Joseph Lorenzo and Wally G. Wilson, in the 413th Judicial District Court of Johnson County, Texas. Represented Rimrock Energy LLC in a lawsuit brought by forty putative lessors alleging numerous causes of action, including breach of contract and fraud in connection with oil and gas leasing activity in Johnson County, Texas. The case settled on the eve of trial.
