Kelly’s practice focuses on the preparation and prosecution of patent applications in the areas of computer hardware and software, network and database management systems, and business methods, with particular emphasis on Internet applications, computer architecture, digital signal processing, semiconductor design, testing and verification, broadband multimedia communications, wireless communications, telephone switching systems, and encryption and decryption technology. Her practice also includes licensing, litigation support and the preparation of validity, infringement and patentability opinions.
Representative Experience
- Grantley Patent Holdings, Ltd. v. Clear Channel Communications, Inc. (E.D. Tex.). Represented defendant and its subsidiaries in a software patent infringement litigation involving yield management, inventory and billing software. (2007-2008)
- B-50, LLC v. XFormity, Inc., Civil Action No. 3:04-CV-0542-B. Represented the alleged infringer in a patent infringement case involving a point of sale reporting system using the Internet. (2006)
- SecureInfo Corporation v. Telos Corporation et al. (E.D. Va.). Represented the trade secret holder in a software case involving trade secret misappropriation and copyright and patent infringement. (2005)
- The SCO Group, Inc. v. International Business Machines Corp. (D. Utah). Defended SCO against software patent infringement claims. IBM withdrew all four patent claims. (2004)
