Paul Radich focuses his practice on counseling governmental entities regarding litigation challenges that occur in the public sector. He has handled cases in both state and federal courts, at the trial and appellate levels. Specifically, Paul handles disputes involving voting rights, civil rights, contract disputes, construction and commercial litigation, tort litigation, election contests, annexation and municipal incorporation, and land-use disputes, including zoning, deed restriction, sign control and other regulatory matters.
Paul also has extensive experience in eminent domain matters and represents both condemning authorities and property owners. He has represented public and private clients regarding the condemnation of property for street extensions and widenings, parks, railroad lines, pipelines, light rail lines, telecommunications facilities, sports venue facilities and transmission lines. Paul also represents both plaintiffs and defendants in real property, construction, environmental, flooding and other land-use litigation.
He also has substantial experience handling challenges to appraisal district valuations of real and personal property for tax purposes. Paul’s experience in this area includes both obtaining and defending tax exemptions, pursuing administrative challenges to valuation and taking on judicial appeals contesting valuation.
Recent eminent domain projects include a major road widening in the City of Stafford, which involved moving infrastructure, railroad tracks and adding overpasses, the widening of several roads and highways using pass-through toll and other funding mechanisms in Montgomery County, which involved the acquisition of several hundred properties, and condemnations for water and sewer infrastructure, drainage facilities and light rail expansion in the City of Houston. In his representation of property owners, he recently has defended against major takings for park use and drainage purposes.
Paul is a contributor, author and lecturer at seminars and conferences on condemnation-related topics.
