Internationally, the Kyoto Protocol is being renegotiated with U.S. involvement and leadership. In the U.S., the federal EPA will require mandatory reporting of greenhouse gas emissions in the power, fuels, industrial and manufacturing sectors beginning January 1, 2010. States and regional partnerships have begun imposing caps on greenhouse emissions, and it is a substantial probability that a federal cap-and-trade and renewable electricity standard will be passed by Congress in 2010.

- Carbon Finance—The Firm recently advised a major financial institution and prepared deal documents and a security agreement as part of a significant transaction for purchase of carbon offsets (Verified Emissions Reductions) from U.S.-based projects.
- International Investment Funds—Andrews Kurth has developed international investment funds using sophisticated risk management techniques to profit from the European Union Emissions Trading Scheme (EU ETS) and the Clean Development Mechanism (CDM) and Joint Implementation (JI) carbon reduction programs.
