Methodology
Selection and Peer Review Process Inclusion in Best Lawyers is based on peer review, as it has been for the past 26 years, and the voting pool for existing categories consists of all lawyers who are currently listed. These listed lawyers are asked to vote on both current listees and new nominees in their specialties and metropolitan areas and/or states, as well as to nominate additional lawyers. Voting takes place either by phone or by electronic ballot. Each listed lawyer is asked “If you could not handle a case, who would you refer it to?” Lawyers are asked to give letter grades (1-5) to the nominees: 5 for someone the voter would definitely refer a case to, 4 for someone the voter would probably refer a case to, 3 for someone the lawyer would be hesitant to refer a case to, etc. Voters are allowed to provide comments as well as grades and are asked to vote only on lawyers whose work they know personally. Votes that are clearly aberrational or politically motivated are ignored. Once selections have been finalized, they are checked against state bar sanction lists to make sure that each lawyer is in good standing with his or her state bar. Once this process is completed, announcements are sent to firms’ marketing departments, and letters of inclusion are then sent to the individual attorneys.
