But is the language used enforceable, and what remedies are available if a party fails to meet its indemnity obligations under the contract? And if an additional insured provision is included in the agreement, what steps can the parties take to maximize effective enforceability of the provision? This CLE program will provide valuable insight and practical advice on how to draft indemnity and additional insured language that is most likely to be successful in the event of a loss.
