Inter Parties Review Blog

Copyright issues have become increasingly complex with the accelerating pace of technological changes in the methods of creating, distributing and exploiting creative works. Whole industries—think of publishing and music alone—have been transformed. The lawyers practicing copyright law on our team excel in tackling the complex copyright problems arising in the wake of these changes. In addition to providing our clients with day-to-day counseling regarding the registration, licensing, policing and enforcement of their copyright rights, we regularly advise on advertising, the sale and acquisition of copyrights and property libraries, asset-based lending and purchase money financing, due diligence inquiries, moral rights, performance rights and related rights.

We also assist our clients in weaving together various layers of copyright and other types of intellectual property protection. For example, because many of our attorneys have technology and engineering backgrounds, we are particularly well suited to attack and solve technology-related issues arising with protecting both trade secrets and copyrights relating to computer software. For example, we developed an effective strategy for registering clients’ software copyrights without having to reveal sensitive trade secrets. Since then, due to the confidentiality concerns of programmers, the United States Copyright Office has instituted a similar procedure for registering software.

Similarly, our lawyers recognize that sometimes an infringement issue that might appear to arise under copyright laws really should be approached as trademark infringement and that sometimes the optimal protection might require pursing a trademark strategy, often in association with a copyright strategy. Many members on our team routinely practice copyright law therefore they also well-versed in trademark law and assist our clients in developing and implementing strategies for protecting and enforcing their copyright and trademarks.

For our international clients, we work closely with non-United States counsel, with whom we enjoy longstanding relationships, to help ensure the international protection of their work.
